All
commercial pools open for public use must be compliant with new 2011
ADA federal regulation by 3/15/11. To help answer a few questions you may
have, here are some question and answers for you to review.
Q. Does my pool need an ADA compliant pool lift?
A.
Any commercial pool with a perimeter of 300 lineal feet or more
needs two means of access. Any commercial pool with less than 300
lineal feet needs one point of access.
Q. What is a commercial pool?
A.
Any pool that is open to the public at any time, receives
government funding, or receives revenue from the pool such as
membership dues.
Q. What is a point of access?
A. A point of access MUST be either a pool lift or a sloped entry.
Q. Does my spa, wading pool, leisure river, or wave action pool need a pool lift?
A.
They all need one point of access. A wading pool must have a sloped
entry. A spa must have a pool lift, transfer wall, or transfer system.
Q. How do I know if my pool lift is compliant?
A.
Here are some basics to check your lift.The lift must have a
capacity of 300 lbs. or more. (Sling seats are not compliant and should
be replaced) The lift must have a solid seat and a footrest.
The lift must be self-operable from the deck and the water. A lift
with manual rotate or crank is not compliant and should be
replaced.
Q. Do Home Owners Associations, Condo Associations and Apartment Complexes’ pools and spas need to become compliant?
A.
Only commercial facilities, places of public accommodation, or
facilities that receive federal funds need to comply. This means that if
the pool at one of these facilities is used to generate
revenue,receives federal funding or is used by persons other than
tenants, their guests and relatives then they need to comply with the
ADA.
